Design Plans terms and conditions.

1. design plans.

1.1 These terms apply to all Tinybox Creative Design Plans: Tinybox Design Lite, Tinybox Design and Tinybox Design Plus. Where terms differ between plans, this is clearly stated.

1.2 Design plans are available on a 12-month commitment (paid monthly) or a monthly rolling basis. Annual commitment pricing is lower and is set out in the table below.

1.3 The plan you have purchased determines your monthly unit allowance:

1.4 All prices are exclusive of VAT.

2. units.

2.1 Design work is allocated in units. Each job type has a fixed unit value as set out in Section 3 of this document. Units reflect the complexity and scope of each job type.

2.2 Unit values by job category are as follows:

  • Quick amends (minor changes to existing artwork): 1 unit each
  • Simple jobs (single, templated design assets): 2 units each
  • Intermediate jobs (custom, considered design work): 4 units each
  • Complex jobs (multi-element or multi-page deliverables): units vary, as stated in the Unit Map in Section 3

2.3 For any job type not listed in the Unit Map, Tinybox Creative will assess the scope and complexity of the work and confirm the unit cost with you before commencing.

2.4 Each job includes up to 2 rounds of revisions as standard. A revision round is defined as a single consolidated set of feedback applied in one pass. Additional revision rounds beyond the standard two will be charged at 1 unit per round.

2.5 If the direction of a job changes significantly after work has commenced, this may be treated as a new job and charged accordingly. Tinybox Creative will notify you before proceeding in such circumstances.

The following table sets out all standard job types and their unit values. This map applies to all Tinybox Creative Design Plans.

For any job not listed above, Tinybox Creative will calculate units as set out in Section 2.3 and confirm with you before commencing work.

5. unit rollover.

5.1 Unused units at the end of a billing month will roll over to the following month automatically.

5.2 Rolled over units expire at the end of the month into which they have been carried. Units cannot be rolled over for more than one month. For example, units unused in March roll over to April but expire at the end of April if unused.

5.3 There is no cap on the number of units that can roll over within the permitted one-month window.

5.4 Rolled over units are used before the current month’s allowance.

6. overage.

6.1 If you use more units than your monthly allowance (including any rolled over units), the excess units will be charged at £37.50+VAT per unit.

6.2 Tinybox Creative will notify you when you are approaching your unit limit for the month. We will always confirm with you before commencing work that would result in overage charges.

6.3 Overage charges will be invoiced separately and are payable within 14 days of the invoice date.

7. rush jobs.

7.1 A rush job is defined as any job requiring turnaround within 48 hours of the brief being received.

7.2 Rush jobs are charged at 1 additional unit on top of the standard unit value for that job type.

7.3 Rush job availability is subject to Tinybox Creative’s capacity at the time of the request and cannot be guaranteed.

8. briefing and scope.

8.1 A clear written brief is required before any design work commences. Tinybox Creative accepts no responsibility for work that does not meet expectations where an adequate brief was not provided.

8.2 Units are allocated based on the original brief. Any additions to the scope of a job after work has commenced may require additional units. Tinybox Creative will notify you before proceeding with any out-of-scope work.

8.3 Tinybox Creative will retain working files and final artwork for all design work produced under an active plan. Upon cancellation, final artwork files will be provided to you in agreed formats.

9. priority access.

9.1 Active design plan clients receive priority over ad hoc design requests. Work submitted by plan clients will be scheduled ahead of any non-plan work received at the same time.

9.2 Most requests are completed within 2 to 3 business days of a complete brief being received. More complex work such as multi-page brochures may take longer. Tinybox Creative will provide a clear timeline when your brief is submitted.

10. payment terms.

10.1 You are required to set up a standing order for the 25th of each calendar month for the amount of your Design Plan.

10.2 Tinybox Creative charges for monthly services one month in advance. The billing cycle runs from the 25th of the month to the 25th of the following month.

10.3 All prices are exclusive of VAT. VAT will be charged at the prevailing rate.

11. late payment.

11.1 If payment is not received by the 25th of the month, we will reach out to arrange payment as soon as possible.

11.2 If payment remains outstanding 14 days after the due date, we reserve the right to pause services until payment has been successfully made. We will always attempt to contact you before taking this step.

11.3 We understand that payment issues can arise and will always work with you to find a reasonable solution. However, in cases of repeated late payment, we reserve the right to apply an administration fee of up to 50% of your monthly plan cost, or to require payment by an alternative method such as direct debit.

11.4 If payment remains outstanding for more than 30 days, Tinybox Creative reserves the right to terminate the plan in accordance with Section 12.

12. termination.

12.1 Should you wish to terminate your Design Plan, you can do so by contacting [email protected].

12.2 If you are on a 12-month commitment, your cancellation will be effective from the end of your 12th month. No refund is available for unused units at the point of cancellation.

12.3 There is a minimum 30-day notice period for cancellations on all monthly rolling plans.

12.4 Upon cancellation, Tinybox Creative will provide all final artwork files produced during the plan in agreed formats within 14 days.

12.5 Any outstanding overage charges remain payable upon cancellation.

13. copyright and intellectual property.

13.1 All design work created by Tinybox Creative for the purposes of this plan shall be owned by the client upon receipt of full payment for the relevant billing period.

13.2 Tinybox Creative does not retain any intellectual property rights for work created for the client as part of this plan.

13.3 The client warrants that any materials, images, text or other content supplied to Tinybox Creative for use in design work do not infringe the intellectual property rights of any third party. Tinybox Creative accepts no liability for any infringement arising from client-supplied materials.

14. liability.

14.1 Tinybox Creative accepts no liability for loss or damage, including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from the use of design materials produced under this plan.

14.2 It is the client’s responsibility to proof-read and approve all design work before use. Tinybox Creative accepts no liability for errors in approved artwork.

15. amendments to these terms.

15.1 Tinybox Creative reserves the right to amend these terms and conditions at any time. Clients will be notified of any material changes by email with a minimum of 30 days notice.

15.2 Continued use of the plan following the effective date of any amendments constitutes acceptance of the revised terms.
